Handyman or Contractor in Rochester, NY: Who to Hire and What the Law Says

New York has no statewide handyman or home improvement license. A written contract is required for home improvement work over $500, and you get three business days to cancel in most cases. Is a handyman license required in New York?

The NYS Department of State says New York does not license home improvement contractors statewide. Only certain localities do, including New York City and a few counties. Rochester and Monroe County are not on the state list of localities that license home improvement contractors, but that is different from saying no rules apply. The state and City still regulate specific trades and contracts.

What the contract must say

New York General Business Law Article 36-A governs home improvement contracts. The New York Attorney General says contracts for work over $500 must be in writing. Under the statute, the contract must include:

  • The contractor name, address and phone number, plus a license number if applicable.
  • Approximate start and completion dates.
  • A description of the work and the materials.
  • The agreed price, and a payment schedule if there is one.
  • A mechanic lien notice and the notice about the contractor deposit rules.
  • Insurance information.

With a handyman or contractor, you must get a signed copy before work begins, written in plain, legible language.

Cancellation and deposits

You can cancel until midnight of the third business day after signing. That right can be waived only in a genuine emergency, with a handwritten waiver. The Attorney General says contractors must keep customer deposits or progress payments in escrow, or provide a bond or indemnity insurance. No source I found sets a maximum deposit percentage, so negotiate a small deposit and never pay cash before signing.

  • High-pressure pushes to sign today.
  • Demands for full payment up front or cash only.
  • No written contract, or a refusal to put the price in writing.
  • No verifiable references.
  • Refusing escrow or a bond for deposits.
