Do You Need a Permit for Deck Repair in Rochester, NY?

For a deck repair permit, the City of Rochester requires a building permit when a deck is 18 inches or more above grade. A $50 Certificate of Zoning Compliance applies whatever the height. What the City of Rochester says about a deck repair permit

These deck repair permit points come from the City of Rochester Bureau of Zoning and Permitting handout on deck permits (October 2024).

  • Building permit: needed when the deck is 18 inches or more above grade. Decks lower than 18 inches do not need a building permit.
  • Certificate of Zoning Compliance: a $50 certificate is needed regardless of deck height, because zoning rules still apply. The City describes it as the document confirming that land use and structural changes meet its zoning rules.
  • Where a deck can go: decks are not allowed in the front yard. A detached deck goes in the rear yard only. An attached deck can go in a side or rear yard, subject to setbacks.

Gap in the handout: it does not say whether a like-for-like repair, such as replacing deck boards or a railing, needs a permit. Do not assume. Call the Bureau of Zoning and Permitting before you replace posts, beams, joists or the ledger.

How to check a deck for rot

Virginia Tech wood researchers describe a simple pick test. Push an ice pick, awl or small screwdriver about a quarter inch into the wood and twist it to lift a splinter. Sound wood gives a long splinter. Decayed wood breaks abruptly across the grain with short, brittle splinters and little sound. The test can pick up decay at 5 to 10 percent weight loss, before the wood looks bad.

Before you ask about a deck repair permit, check these spots first, because water collects there:

  • Where the deck meets the house at the ledger.
  • The tops of posts and the ends of boards.
  • Stair stringers and where steps meet the ground.
  • Anywhere a board sits flat against another board.

What good deck construction looks like

Many local deck standards follow the American Wood Council guide DCA 6. One city amendment of that guide, from Wichita, Kansas, is a useful plain-language checklist. It is not Rochester law, so treat it as a reference point, not a code citation.

  • The ledger is fastened with bolts or lag screws, not nails, and the fasteners are hot-dip galvanized or stainless steel, with flashing.
  • The ledger is not attached to brick or stone veneer, or to a cantilever or bay window.
  • Guards are needed on decks above 30 inches, and are 36 inches high and built to carry a 200 pound load.
  • Guards are fixed to posts with real fasteners, not toe-nails.

If a ledger board has pulled away from the house or the posts have rot at the base, that is structural work. Get the permit question answered and the structure inspected before cosmetic repairs.

Replacing loose or split boards, resetting a wobbly railing, fixing steps and re-securing trim are typical deck repair jobs. A failed ledger, rotted posts or a deck that needs to be raised or rebuilt is a larger project that may need a permit and an engineer or contractor.
